Kuare CRM: Terms & Conditions for the Customer Relationship Management System
Welcome to the Kuare CRM System (the "System"). By accessing or using this System, you (the "User") agree to be bound by the following Terms & Conditions ("Terms"). Please read these Terms carefully. If you do not agree with these Terms, you must not use the System.
1. Definitions
- "Company": Refers to the organization that manages the Kuare CRM, including its staff and authorized agents.
- "Customer": Refers to any individual or organization that interacts with the CRM, such as clients or customers.
- "System": Refers to Kuare CRM, including any associated platforms, websites, or services provided by the Company.
- "User": Refers to anyone who accesses or uses the System, whether as an employee, customer, or visitor.
2. System Access
The Company grants you a limited, non-exclusive, and revocable license to access and use the System for managing customer information, interactions, and related services.
Eligibility:
- You must be at least 18 years old to access or use the System.
- By using the System, you confirm that all information you provide is true, accurate, and up to date.
3. Customer Registration
To become a registered customer, you must complete the registration process by providing the required information, such as your name, contact details, and any relevant information for customer relationship management.
4. Payment Terms
All payments made through the System for any paid services or add-ons are subject to the following terms:
- Payment Methods: The System accepts mobile payments (e.g., M-Pesa, TIGO-Pesa, Airtel Money) and international payments via PayPal.
- Refund Policy: Payments are non-refundable unless expressly stated otherwise. Refunds for erroneous payments will be handled on a case-by-case basis at the discretion of the Company.
- Currency: Payments made through mobile platforms will be processed in Tanzanian Shillings (TZS), while international payments may be processed in USD or other accepted currencies.
5. Data Protection and Privacy
The Company respects your privacy and is committed to protecting your personal data. Please refer to the Data Protection Compliance Policy for more details on how we collect, store, and process personal data.
- Data Collection: By using the System, you consent to the collection and use of your personal information, such as contact details and payment information, for the purpose of managing customer relationships and interactions.
- Security: The Company takes reasonable measures to secure personal data, including encryption and access controls. However, no system is completely secure, and the Company cannot guarantee absolute security.
6. Use of the System
By accessing the System, you agree to:
- Provide Accurate Information: Ensure that all personal and payment details provided during registration and payment processes are accurate and up to date.
- Prohibited Use: You must not use the System for any unlawful purpose or to infringe on the rights of others. This includes but is not limited to:
- Misusing the System by uploading harmful content, such as viruses or malware.
- Using the System to engage in fraud or to obtain unauthorized access to data.
- Impersonating another person or entity.
7. Intellectual Property
All content, trademarks, logos, and other intellectual property rights within the System remain the property of the Company. You may not copy, reproduce, or distribute any part of the System without explicit permission from the Company.
8. Limitation of Liability
To the maximum extent permitted by law:
- The Company is not liable for any indirect, incidental, special, consequential, or punitive damages arising from the use of the System, including any loss of data, revenue, or profits.
- The Company does not guarantee the accuracy, completeness, or availability of the System at all times. The System may be unavailable due to maintenance, upgrades, or technical issues, and the Company is not responsible for any interruptions in service.
- You are responsible for ensuring that your use of the System complies with local laws and regulations, including data protection laws.
9. Termination and Suspension
The Company reserves the right to terminate or suspend your access to the System at its sole discretion, including for reasons such as:
- Violation of these Terms;
- Fraudulent or unlawful activity;
- Non-payment for any paid services or add-ons.
Upon termination, you must immediately cease all use of the System. Any outstanding fees will remain due.
10. Amendments to the Terms
The Company reserves the right to amend these Terms from time to time. Any changes will be posted on the System or communicated to you via email. Continued use of the System following any changes constitutes your acceptance of the revised Terms.
11. Governing Law and Jurisdiction
These Terms are governed by and construed in accordance with the laws of Tanzania. Any disputes arising from the use of the System will be subject to the exclusive jurisdiction of the courts in Tanzania.

13. Miscellaneous

- Entire Agreement: These Terms, along with any other policies referenced herein, constitute the entire agreement between you and the Company concerning the use of the System.
